“Disputes Tribunal ruling: Southern Plumbing & Gasfitting failed to meet their obligations under the Consumer Guarantees Act by not providing a service with reasonable care and skill. Not giving repair options and not providing a repair quote as we requested. The Tribunal also found that although we were told parts were likely not available, Southern Plumbing knew or should have known that parts were available. We engaged Southern to assess a fault with our central heating furnace. Repair options were withheld and replacement was presented as the solution, which we proceeded with at a cost of approximately $13,000, believing this was the only option. This occurred despite our direct dealings with Doug, the owner. Only by chance did we later find out parts were readily available and repair was straight forward at a cost of about $700. When we raised our concerns, we were threatened with legal action rather than trying to find a resolution. We strongly recommend obtaining independent advice and written confirmation of all repair options before agreeing to replacement work with this firm. UPDATE: Southern Plumbing’s comment below states that our claim was “thrown out.” This is incorrect. The Disputes Tribunal found that Southern Plumbing & Gasfitting Ltd breached the Consumer Guarantees Act and that we suffered a loss as a direct result of their actions. The Tribunal also required payment of only part of the invoice, not because the service met the required standard, but following its assessment of the circumstances.
